Agreement to Terms

By accessing or using the NurtureOS website, platform, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and NurtureOS Systems. You must be at least 18 years old or the age of legal majority in your jurisdiction to use our Services.

Developmental Guidance, Not Diagnosis

NurtureOS provides developmental guidance based on established pediatric research and child development science. You acknowledge and agree that:

• Our Services are supportive in nature and do not replace professional clinical diagnosis, medical advice, or treatment.
• You should always consult with qualified healthcare professionals (pediatricians, child development specialists, etc.) regarding your child's health, development, or any medical concerns.
• NurtureOS does not provide medical diagnoses, prescribe treatments, or offer emergency medical services.
• In case of medical emergencies, contact emergency services immediately.

Accurate Information

Users must provide accurate and truthful information to receive valid developmental insights. You agree to:

• Provide accurate information about your child's age, developmental milestones, and relevant health information.
• Update your information promptly if circumstances change.
• Use the Services in compliance with all applicable laws and regulations.
• Not misrepresent yourself, your child, or your relationship to any child.

Prohibited Conduct

Misuse of the platform or attempts to reverse-engineer our proprietary growth algorithms is strictly prohibited. You may not:

• Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of any software comprising or making up the Services.
• Use any automated means to access the Services or collect data from the Services.
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Interfere with or disrupt the Services or servers or networks connected to the Services.

Research-Driven Updates

Our content and protocols are updated regularly as new research emerges. By using the Services, you agree to receive updated activity content and guidance to ensure your child's developmental support remains accurate and age-appropriate.

We may modify, update, or discontinue features of the Services at any time without prior notice. We will make reasonable efforts to notify you of significant changes that may affect your use of the Services.

Ownership

All intellectual property rights in the Services, including but not limited to content, activity frameworks, software, designs, text, graphics, and logos, are owned by or licensed to NurtureOS Systems.

You retain ownership of any information you submit to the Services (e.g., milestone responses, assessment answers). You grant NurtureOS a limited license to process this data solely to provide the Services to you. NurtureOS does not claim any ownership over your child's developmental data.

Your Data, Your Control

Your privacy is paramount. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Key privacy commitments:

• Data minimization: We collect only what is necessary to deliver the service (phone number, child age, completion responses, ASQ-3 scores)
• Encrypted storage: All data is stored on Microsoft Azure (South Africa region) with AES-256 encryption at rest
• No profiling or selling: Your data is never sold, used for advertising, or shared with third parties beyond essential service providers
• End-to-end encryption & zero-knowledge architecture: Applies to the future standalone NurtureOS platform. During the WhatsApp MVP phase, conversations are transmitted through Meta (WhatsApp) and Twilio infrastructure and are subject to their respective privacy policies
• Data deletion: Reply DELETE MY DATA on WhatsApp or email support@getnurtureos.com to permanently delete your account and data

Third-Party Platform Terms

During the pilot phase our services will be delivered via WhatsApp. By using the Services during that period, you also agree to be bound by WhatsApp's Terms of Service and WhatsApp's Privacy Policy. NurtureOS is not responsible for Meta's or Twilio's data handling practices.

No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NURTUREOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL NURTUREOS, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Your Responsibility

You agree to indemnify, defend, and hold harmless NurtureOS Systems, its founders, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

Service Discontinuation

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. You may also terminate your account at any time by:

• Replying STOP on WhatsApp to opt out of all messages
• Replying DELETE MY DATA on WhatsApp to fully delete your account and data
• Emailing support@getnurtureos.com

Upon termination, your personal data will be permanently deleted within 30 days in accordance with our Privacy Policy.

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Rwanda, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Kigali, Rwanda.

Updates & Notification

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website and updating the "Effective Date" above. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
